In January 2014 nine people were indicted on 10 counts, chief among them: “Conspiracy to Defraud the United States” and “Conspiracy to Commit Marriage Fraud.”
That lengthy indictment, which is below, lays out a complex, decades-long scheme involving a 61-year-old mother, her 32-year-old daughter, seven other family members, phony immigration documents, counterfeit birth certificates, fraudulent tax returns and identity theft. The operation was undone in 2010 by an undercover government agent in Dallas “posing as an illegal alien” in need of a phony immigration application, according to the indictment.
The mother, Frances Sandoval, and her daughter Monica Morena pleaded guilty in March to conspiracy to commit fraud in connection with immigration documents and aggravated identity theft. Just yesterday, Sandoval was sentenced to 65 months in federal prison; she must also forfeit $45,850. Morena’s sentence handed down Wednesday in Dallas federal court is shorter (48 months), and her financial penalty is smaller ($21,710).
The others involved, three of whom are also Frances Sandoval’s children, have already pleaded guilty to marriage fraud or conspiracy to commit marriage fraud. Their sentences were relatively light: two years probation with 120 days of home confinement. Their fines ranged from $2,000 to $5,000. Bartola Contreras, Sandoval’s 55-year-old husband, was convicted in March on one count of conspiracy to commit marriage fraud and sentenced to six months in federal prison and a $2,000 fine.
According to the U.S. Attorney’s Office simplied version of this lengthy tale, Sandoval and Moreno “prepared and filed fraudulent applications for family unity, which included counterfeit birth certificates and fraudulent income tax returns and affidavits. They used the fraudulent documents to make it appear that aliens without lawful status in the U.S. were children of U.S. citizens or lawful permanent residents. For identity documents for the ‘parents,’ Sandoval and Moreno used actual naturalization certificates and copies of permanent resident cards that Sandoval obtained from her tax clients, without the clients’ knowledge or permission.”
