Two weeks ago, Vanessa Ortega was watching the news at her cousin’s house when suddenly her brother’s picture flashed on the screen. Police had arrested two suspects in the death of Leonardo Ortega, 28, who was killed by robbers while working at an Oak Cliff Subway.

“I was very excited,” Vanessa Ortega, 25, said Wednesday. “But I always thought to myself, ‘I’m just going to wait until the trial date because anything could happen.’”

Her skepticism turned out to be warranted. This week, Dallas police announced the capital murder case unraveled and they had to free both suspects, Christopher Miller, 35, and Anderson Jones, 40. The lead detective, Elena Perez, was transferred out of homicide and placed under internal investigation for possibly violating policies.

Police declined to say how Perez may have mishandled the case, citing the open investigation. But a report on WFAA-TV said she is accused of improperly swaying Miller, who is mentally challenged, to identify Jones as his accomplice. Miller became a suspect through an anonymous Crime Stoppers tip.

According to the WFAA-TV report, Miller first failed to identify Jones as the shooter in a photo lineup presented by a team of officers. After the team left the room, Perez showed Miller a photo of Jones, whom he confirmed to be the shooter, the report says. That would mean the detective used a flawed identification to convince a judge to sign the warrant.

Perez wrote in her arrest warrant affidavit that Miller “confessed” that both men planned and participated in the crime, and that Miller “picked suspect Jones from a photo line up as the person with the gun.”

Anderson Jones

Miller’s attorney, Edwin King, said his “intellectually challenged” client may have been coerced. “I think he’s somebody who, you get confused and get scared, and he might just say anything to get the pressure off him,” King said.

King said police didn’t seem to have any physical evidence tying the two suspects to the slaying at the Wynnewood Village shopping center near Zang Boulevard and Illinois Avenue. Jones’ attorney, Brad Lollar, said his client was at his girlfriend’s house several miles away at the time of the crime, and has cell phone records to prove it.

The two robbers wore masks and a surveillance camera was not working.
