A judge is expected to deliver a verdict today in the case of a Dallas man accused of shooting an 8-year-old boy in the face at a Lake Highlands apartment complex.
Brian Cloninger’s family testified Monday morning in his injury to a child trial, describing the 48-year-old as easygoing and a trustworthy and competent friend. They said they were unaware of his drinking issues or his interest in transgender women.
Last week, a transgender prostitute testified that Clonginger was visiting her apartment at La Bella Palms on Sept. 3, 2013, the day Donald Maiden Jr. She said he drank several beers and was acting belligerent before the shooting, so she asked him to leave.
The boy crossed paths with Cloninger shortly afterward and was shot.
Cloninger is charged with injury to a child and faces up to life in prison if convicted. He waived his right to a jury trial, and Judge Gary Stephens is expected to deliver the verdict this afternoon.
In the defense’s opening statements, attorney Drew Gatlin described the day of the shooting as one Cloninger could hardly remember.
“We’re ultimately going to ask the court to find him not guilty,” Gatlin said.
