The family of a 28-year-old man shot and killed by Duncanville police officers in the fall of 2013 has sued the department, its chief and three officers in Dallas federal court, claiming they used “force that was clearly excessive” and that “the excessiveness of the utilized force was clearly unreasonable.”
The shooting of Clinton Peterson, a Utah native, made national news on October 28, 2013, after he was shot from behind by officers who claimed he’d led them on a “foot chase” following a “major disturbance” in a residential neighborhood. That major disturbance, says the suit, was anything but: Clint had gone to his sister Melissa’s house to see one of her housemates, with whom he’d been involved in “an intermittent relationship.” But that housemate, Debra, didn’t want to see Clint, and called 911 to have police escort him off the premises.
The suit says Clint stuck around just long enough to get a cigarette from Debra’s daughter Shyanna, and that he was leaving as officers arrived. The suit says reiterates what Melissa, Debra and Shyanna have long maintained: Clint wasn’t looking for trouble when officers arrived and immediately shot him with a Taser, which has little effect on 28=year-old.
“Unfortunately, when the TASER deployment failed to stop Peterson’s attempted peaceful departure, Defendant Doe I once again needlessly escalated the situation by firing two (2) rounds at Peterson, a passive, non-violent, and wholly unarmed victim,” says the suit. “Doe I fired these two (2) shots at close range, both shots were made in quick succession, and it is believed that it was the second shot which fatally struck Peterson in the right side of the head, just behind his right ear. Both of Officer Doe I’s shots were fired while Peterson was attempting to disengage and flee from the encounter.”
The autopsy, released last March, said he died after being stuck by a bullet that entered his skull behind the right ear. And as Unfair Park noted last year, the autopsy also confirmed what Melissa told police — that police didn’t even attempt to help Clint after he’d been shot.
“There is no evidence of emergency resuscitation or medical therapy,” says the autopsy. Adds the lawsuit, the officers “simply stood guard over Peterson’s dying body until a
medical unit appeared some fifteen (15) minutes later—by which time Peterson had quite literally bled to death on the ground in full view of his friends and family (including his sister and bystander claimant, Plaintiff Melissa Peterson).”
The suit was filed by three attorneys, one in Dallas, on behalf of Clint’s ex wife, his daughter and Melissa, who, says the suit, “suffered and continues to suffer extreme emotional distress” after watching her brother gunned down in the street by police officers.
